If you’re going through a divorce in Utah, you may have been hearing about divorce mediation.
Mediation is a process in which you and your spouse (or ex) meet with a neutral third party (the mediator) to discuss the terms of your divorce. The mediator is typically trained in law or communications. Their job is to listen to both sides and help guide you to a resolution.
In 2005, mediation became mandatory in Utah for all contested divorces. In other words, if you're planning to do a traditional divorce involving attorneys, you'll still be required to attend mediation prior to your case being heard by a judge.
During mediation, you and your spouse (or ex) can meet separately with the mediator, or everyone can meet together in the same room. You may have an attorney present, or you may have a “support person” such as a family member. You can also attend mediation alone.
Though the mediator can't give you legal advice like an attorney can, they are allowed to explain how the law works, describe common outcomes, and, in some cases, help you explore creative solutions. Above all, their job is to help you explore options and let you decide for yourself what terms you want to agree to.
