If you’re going through a divorce in Utah, you may be wondering if you need to hire a divorce attorney.
The short answer is that it depends. If you and your spouse (or ex) are locked in a high-conflict battle, if you have high assets or complicated assets, or if one or both parties are intent on fighting over every aspect of the divorce, then you probably need to consider hiring attorneys.
In contrast, if you and your spouse (or ex) are striving for an amicable split, you have relatively low assets, and you’re both willing to come to an agreement on the terms of your divorce, mediation may be a perfect tool for you.
During mediation, a trained professional (the mediator) will talk with each of you about your goals, your priorities, and your desired outcomes. This includes custody, financial issues, and dividing your marital assets. They will then help you explore possible solutions and guide you toward a resolution that works for all parties.
While a mediator cannot advocate for either of you like an attorney does, the mediator can provide basic explanations of the law, describe common outcomes in Utah divorces, and, where appropriate, help find creative solutions for your case.
At the end of mediation, your mediator will prepare a draft agreement for you to take home and review. At that point, you and your spouse (or ex) can choose to consult with attorneys before signing and finalizing your agreement. Your attorneys can help ensure that the agreement is reasonable and fair.
